Well-funded services like ChatGPT, Grok, DeepSeek, Perplexity and MetaAI are rapidly gaining users and distribution, and adding innovations at a breakneck pace. Evidence at trial showed OpenAI believes \u201cit has what it needs to win.\u201d<\/li>\n<li data-block-key=\"ahhhg\">Our ability to enter into promotional agreements isn\u2019t holding back this new generation of competition. Apple recently chose to feature ChatGPT in Apple Intelligence, while Motorola has already integrated Perplexity and Microsoft\u2019s CoPilot into its new Razr devices.<\/li>\n<\/ul>\n<h2 data-block-key=\"a3uib\">DOJ\u2019s proposals would leave consumers with worse experiences and fewer choices.<\/h2>\n<ul>\n<li data-block-key=\"2msue\">Apple\u2019s SVP of Services Eddy Cue said Apple chooses to feature Google because it\u2019s \u201cthe best search engine\u201d and that it keeps improving with new innovations like AI Overviews. In contrast, DOJ\u2019s proposals would make it harder for people to get the search engine they prefer.<\/li>\n<li data-block-key=\"9ucp\">DOJ\u2019s proposals would also hurt widely used browsers, leaving consumers with fewer choices. Mozilla CFO Eric Muhlheim said the DOJ\u2019s proposals would harm browser competition and \u201cput Firefox out of business.\u201d<\/li>\n<\/ul>\n<h2 data-block-key=\"45l7s\">Mandating data disclosures would threaten Americans\u2019 privacy.<\/h2>\n<ul>\n<li data-block-key=\"g06c\">Privacy expert Dr. Chris Culnane testified that DOJ\u2019s proposals demand even more data than Europe\u2019s Digital Markets Act, threatening to reveal people\u2019s personal information and behavior, and threatening widespread privacy breaches. The Software Industry Information Association wrote that \u201c[i]t\u2019s virtually certain that forced sharing of search data will expose users and the internet ecosystem to untold privacy and security risks.\u201d<\/li>\n<li data-block-key=\"c967h\">Even a witness from Microsoft \u2014 the company that stands to gain the most from DOJ\u2019s proposals \u2014 admitted that \u201cprivacy concerns are not made up.\u201d<\/li>\n<\/ul>\n<h2 data-block-key=\"ar92k\">De facto divestiture would hold back innovation at a critical juncture.<\/h2>\n<ul>\n<li data-block-key=\"6s5va\">While we\u2019re at a key moment in the global technology race, Sundar Pichai testified that the DOJ\u2019s proposals amount to a \u201cde facto divestiture\u201d of Search, and VP of Search Liz Reid confirmed that they would \u201csignificantly hamper\u201d innovation. While Google spends billions every year on R&amp;D \u2013 $49 billion last year alone \u2013 DOJ\u2019s proposal to confiscate the benefit of those innovations would reduce incentives for future investment.<\/li>\n<li data-block-key=\"3tcl\">University of Chicago economist Dr. Kevin Murphy found that forced sharing of data and intellectual property would reduce incentives for rivals to innovate. As Murphy explained, \u201cshortcutting to get to the end\u201d usually doesn\u2019t work out the way you want it to, making it more likely that rivals would seek to clone Google rather than doing their own differentiated innovation.<\/li>\n<\/ul>\n<h2 data-block-key=\"8r8ol\">Divesting Chrome would break it \u2014 and many other things.<\/h2>\n<ul>\n<li data-block-key=\"6sg91\">DOJ\u2019s proposal to break off Chrome \u2014 which billions of people use for free \u2014 would break it and result in a &#8220;shadow of the current Chrome,\u201d according to Chrome leader Parisa Tabriz. She added that the browser would likely become \u201cinsecure and obsolete.\u201d Open Web Advocacy and a wide range of voices agreed that it would do more harm than good.<\/li>\n<li data-block-key=\"51gt1\">Columbia University Professor Jason Nieh testified that breaking off Chrome would be \u201chighly challenging\u201d since it&#8217;s deeply integrated into Google\u2019s infrastructure. And the result would degrade products like Safe Browsing, ChromeOS, the open-source Chromium project and more.<\/li>\n<li data-block-key=\"b2dkl\">Google cybersecurity chief Heather Adkins warned that severing Chrome from Google&#8217;s security infrastructure would expose billions of people to cyber-attacks.<\/li>\n<\/ul>\n<h2 data-block-key=\"2qtsj\">DOJ\u2019s proposals would help competitors, not consumers.<\/h2>\n<p data-block-key=\"athqc\">Over weeks of testimony, we heard from a series of well-funded companies eager to gain access to Google\u2019s technology so they don\u2019t have to innovate themselves.
