In some of the most high-stakes AI copyright fights, a \u201cbig contention\u201d among model makers that\u2019s key to their defense is that original works are <em>not <\/em>included in outputs, Goldman pointed out.<\/p>\n<p>\u201cAnd we\u2019ve seen where the copyright owners are able to replicate identical outputs, that actually makes the cases much higher stakes for the defendants,\u201d Goldman said. \u201cAnd so at best, this case could possibly have an impact for those cases where the copyright owner has got the smoking guns of original index material coming out identically.\u201d<\/p>\n<p>However, \u201cI don\u2019t even think it\u2019s likely to do that,\u201d Goldman said, since \u201cmeme generators are just such a niche because of the fact that they\u2019re memes,\u201d which inherently only work when they\u2019re copied without permission.<\/p>\n<p>\u201cIf someone creates a visual image and tells the world, \u2018Please make this into a meme,\u2019 that would never work,\u201d Goldman said. \u201cMemes that grow organically from the multiple individual decisions to copy it without permission, so copyright law and meme law don\u2019t really play together very nicely.\u201d<\/p>\n<p>Saflor thinks that AI\u2019s rise in popularity is the perfect time to change that and \u201crecognize that behind every iconic meme is a real creator,\u201d Saflor told Ars. \u201cRespecting copyright encourages creativity and ensures artists aren\u2019t left behind as technology evolves.\u201d<\/p>\n<p>Saflor uses AI tools and does not believe that AI itself is the problem. Goldman pointed out that his arguments against Memes Apps would be largely the same even without the AI aspect.
